1. Acceptance of Terms

By accessing and using the Eyatrip platform, mobile applications, and services (collectively, the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of the Service operated by Eyatrip ("we," "us," or "our"). We reserve the right to modify these terms at any time, effective upon posting of modified terms on the Service.

2. Description of Service

Eyatrip is a car rental platform that connects car owners ("Hosts") with individuals seeking to rent vehicles ("Renters"). Our Service facilitates the booking and management of car rentals but does not own, sell, resell, furnish, provide, rent, re-rent, manage, or control any vehicles.

We provide an online platform for Hosts to list their vehicles and for Renters to find and book vehicles. We are not a party to any rental agreement between Hosts and Renters.

3. User Eligibility and Registration

To use our Service, you must meet the following requirements:

• Age Requirement: You must be at least 12 years old
• Driver's License: You must possess a valid driver's license
• Account Creation: You must create an account with accurate information
• Verification: You must complete identity verification as required
• Compliance: You must comply with all applicable laws and regulations

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Host Responsibilities

As a Host, you agree to:

• Vehicle Ownership: Only list vehicles you own or have authority to rent
• Accurate Information: Provide accurate and complete vehicle information
• Vehicle Condition: Ensure vehicles are in safe, roadworthy condition
• Insurance: Maintain appropriate insurance coverage for your vehicles
• Maintenance: Keep vehicles properly maintained and serviced
• Availability: Honor confirmed bookings and maintain vehicle availability

Hosts are responsible for ensuring their vehicles meet all local safety and regulatory requirements.

5. Renter Responsibilities

As a Renter, you agree to:

• Safe Operation: Operate vehicles safely and in accordance with traffic laws
• Vehicle Care: Treat vehicles with care and return them in the same condition
• Fuel: Return vehicles with the same fuel level as received
• Damage Reporting: Report any damage or issues immediately
• Authorized Drivers: Only allow authorized drivers to operate the vehicle
• Return Time: Return vehicles on time and at the agreed location

6. Payment and Fees

Our Service operates on the following payment structure:

• Rental Fees: Set by Hosts and agreed upon during booking
• Service Fees: Eyatrip charges a service fee for facilitating rentals
• Security Deposits: May be required and held until vehicle return
• Additional Charges: Late fees, cleaning fees, or damage charges as applicable
• Payment Processing: All payments are processed through secure third-party providers

All fees are clearly displayed before booking confirmation. Payment is processed at the time of booking.

7. Cancellation and Refund Policy

Cancellation policies vary based on the timing and circumstances:

Renter Cancellations

• 24+ hours: Full refund minus service fees
• 2-24 hours: 50% refund minus service fees
• Less than 2 hours: No refund

Host Cancellations

• 24+ hours: No penalty
• Less than 24 hours: May result in account restrictions

8. Prohibited Activities

The following activities are strictly prohibited:

• Using vehicles for illegal activities or transporting illegal substances
• Racing, off-roading, or other high-risk driving activities
• Smoking in vehicles (unless explicitly permitted by Host)
• Transporting pets without Host permission
• Exceeding vehicle capacity or weight limits
• Crossing international borders without Host permission
• Subleasing or transferring vehicles to third parties

Violation of these prohibitions may result in immediate account termination and legal action.

9. Insurance and Liability

Insurance coverage is a critical aspect of our Service:

• Host Insurance: Hosts must maintain appropriate insurance coverage
• Renter Coverage: Renters may be covered under Host's policy or need additional coverage
• Eyatrip Coverage: We provide limited liability protection for qualifying incidents
• Exclusions: Certain activities and damages may not be covered
• Claims Process: All claims must be reported within 24 hours

Users are encouraged to review their personal insurance policies and understand coverage limitations.

10. Dispute Resolution

We encourage users to resolve disputes amicably. If resolution cannot be reached:

• Mediation: Eyatrip may facilitate mediation between parties
• Documentation: All disputes must be documented with evidence
• Time Limits: Disputes must be reported within 30 days
• Legal Action: Users may pursue legal remedies as available under law

11. Termination

We may terminate or suspend your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activities
• Repeated policy violations
• Failure to resolve disputes appropriately
• Any other reason at our sole discretion

You may terminate your account at any time by contacting our support team.

12. Limitation of Liability

To the maximum extent permitted by law:

• Eyatrip's liability is limited to the amount paid for our services
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for actions of users or third parties
• We are not liable for vehicle-related incidents or damages

These limitations do not apply where prohibited by law.

13. Governing Law

These Terms are governed by the laws of Quebec, Canada. Any disputes will be resolved in the courts of Montreal, Quebec, unless otherwise required by applicable law.

14. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting on our Service. We will notify users of material changes through:

• Email notifications to registered users
• In-app notifications
• Updates to our website
